A ﬁve-judge bench headed by Chief Justice Dipak Misra held that Aadhaar would be voluntary and not mandatory. The majority judgment, which struck and read down or clariﬁed various provisions of the Aadhaar Act, was read out by Justice A K Sikri speaking for Chief Justice Misra and Justice A M Khanwilkar and himself. Justice Ashok Bhushan delivered a separate but concurring judgment. A five-judge bench struck down the Sections 33(2), 47 and 57 of Aadhaar Act, which allowed corporate entities or even individuals to demand an Aadhaar card in exchange for goods or services. As a result, now no school, office, or company can force anyone to reveal the unique 12-digit number. Neither is it mandatory for opening bank accounts or for mobile connections. Act do not tend to create a surveillance state. "This is ensued by the manner in assing the Aadhaar law as money bill was unconstitutional and a fraud on the Constitution because it was not a money bill – Justice Chandrachud which the Aadhaar project operates." In his dissenting judgement, Justice D Y Chandrachud held that the entire Aadhaar programme since 2009 suffered from constitutional inﬁrmities and violated fundamental rights. The enactment of Aadhaar Act does not save the Aadhaar project. The Aadhaar Act, the rules and regulations framed under it and the framework prior to the enactment of the Act were unconstitutional. The Supreme Court also observed that Aadhaar is not mandatory for UGC, NEET & CBSE examinations. The biometric data shall not be shared with any agency without the permission of the court, added SC. According to reliable sources, the state government has inputs that the notiﬁcation for the Assembly elections might be issued on October 5 or 6 to pave way for early elections. A Bill to replace MCI with National Medical Commission is pending in Parliament.
