Holding that the earlier observation was made in the limited context of "land acquisition" during the hearing of the Ayodhya case, the top court in a 2-1 verdict made it clear it will not have any bearing in the Ram Janmabhoomi-Babri Masjid title dispute whose outcome will be eagerly awaited ahead of the 2019 Lok Sabha polls. Speaking after moving the condolence motion in the Legislative Council, Chandrashekar Rao said that a statue and a memorial would be established in Hyderabad city in the memory of Atal Bihari Vajpayee. Rao recalled that the BJP leaders had met him and sought memorial of Vajpayee in Hyderabad. He said that already orders were issued and the officials were on the job. Recalling Vajpayee’s leadership, Rao said that he was a great statesman who has brought name and fame to the country at international level. He was the great orator and poet. Several landmark schemes such as Pradhan Mantri Grameena Sadak Yojana, have changed the face of the villages in the entire country. Kargil War and Pokran nuclear test are some of Vajpayee’s initiatives which have shown the strength of the nation, said Rao. In a chat with media persons, Rajender said that the TRS-led government was employee-friendly and would announce at least little, if not big, IR for the staff. He mentioned contract employees previously had no security, but now they were paid salaries as per the minimum wages act. Except for staff of Centre’s Sakshar Bharat, all contract workers were being paid salaries by the state government, he said. The minister said that going by the speed of the Election Commission, there were chances that the State would have elections in November. He said that formation of Mahakutami was an advantage for TRS. The Telugu Desam Party was formed against the Congress party, he added. He predicted that Mahakutami candidates would not be able to even retain their deposits. Rajender said that people knew what the government had done for them. The opposition was alleging that Bhagiratha water was not coming but people were seeing the works going on in their areas. The construction of double-bedroom houses in some places was delayed because of lack of lands. However, he said that the works were going expeditiously and soon the houses would be handed over to the beneﬁciaries. Continued on Page 4 ‘Triple Talaq’ edict murder of democracy: AIMPLB Hyderabad: The All India Muslim Personal Law Board (AIMPLB) on Thursday alleged the ordinance making instant triple talaq a punishable offence is a murder of democracy, and said it is exploring legal options to challenge the move. It said the government did not bother to discuss the issue in Parliament and it's an insult to the country's supreme legislative body. Even AIMIM president and Hyderabad MP Asaduddin Owaisi came down heavily on the ordinance. Describing the 'triple talaq' ordinance a "fraud", Owaisi said it should be challenged in court. "I personally feel there is a need to challenge this ordinance in court... This is a wrong ordinance. It is a fraud... There are mistakes," Owaisi OWAISI CALLS IT A FRAUD AIMIM chief Asaduddin Owaisi addressing the media in Hyderabad on Thursday said. According to Owaisi, the ordinance is the Bharatiya Janata Party's "technique" to divert people's atten- tion from the Rafale issue, Nirav Modi, Mehul Chowksi and rising petrol prices. Speaking to reporters in Hyderabad, AIMPLB assistant general secretary Maulana Khalid Saif Ullah Rehmani said, "This ordinance is a 'chor darwaza'. It's a murder of democracy and an insult to Parliament. The Parliament session is to start... but the government did not even bother to discuss... We feel it will be harmful to Muslim women." The Maulana said it's strange that no consultations were held with the community and "you (government) decided on it yourself. Rather than rendering justice, injustice will be meted out through this ordinance". Asked if the board will move the Supreme Court against the ordinance, Rehmani said, "Our legal committee will discuss and may consider it (legal options)." President Ram Nath Kovind had last Wednesday signed the ordinance making instant triple talaq illegal and void. The offence will attract a jail term of three years for the husband. Seeking to allay fears that the law could be misused, the government also included some safeguards in it, such as providing for bail to the accused. CONGMEN TOLD TO BRACE UP FOR ANY EVENTUALITY Adultery no longer a crime Supreme Court scraps colonial law New Delhi: Adultery is no longer a crime in India, the Supreme Court ruled on Thursday as it struck down the colonial-era law, dubbing it "archaic" and "unconstitutional" and saying it treated women as a "chattel" and denuded them of their "sexual autonomy". In a path-breaking judgement, a ﬁve-judge constitution bench headed by Chief Justice Dipak Misra unanimously struck down section 497 of the Indian Penal Code (IPC) dealing with offence of adultery and section 198 of the CrPC which deals with prosecution of offences against marriage. With this verdict, India joined a list of countries, including China, Japan, Brazil, Australia, Germany and France, which have done away with the penal provision criminalising adultery. The CJI, who wrote the lead judgement for himself and on behalf of Justice A M Khanwilkar, held that "a husband is not the master" and any system treating a woman with indignity, inequity and inequality or discrimination "invites the wrath of the Constitution". The other three members of the bench -- Justices Rohinton F Nariman, D Y Chandrachud and Indu Malhotra -- concurred with the view that adultery should not be treated as an A good riddance Sec 497 is clear violation of fundamental rights granted in the Constitution and there is no justification for continuation of the provision offence, termed it as manifestly arbitrary, retrogade and cannot be allowed to continue. Justice Nariman, while holding that section 497 was "utterly irrational" and archaic as it demeaned the status of women, made it clear that the penal provision discriminated against women only on grounds of sex and violated their right to equality. Section 497 of the 158year-old law, which was punishable by a maximum ﬁve years in jail or ﬁne or both, says: "Whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of adultery." Similarly, Justice Chandrachud held that the provision was "destructive" and deprived women of their "autonomy, dignity and privacy." He also said that sexuality, which was a definitive expression of identity of a woman, was part of her "inviolable core" and neither the state, nor the institution of marriage could disparage it. Justice Malhotra, the lone woman judge in the bench, held that any law which discriminated between persons on the basis of sex alone and deprived women of the right to prosecute, was not gender-neutral and liable to be struck down. This implies that the caretaker government headed by K Chandrasekhar Rao can- not make any new promises or announce any new schemes until completion of the poll process was over. In letters to the Centre and states, the poll body said that as the government ruling in such circumstances is only playing the role of a "caretaker", the question of allowing the introduction of potentially populist schemes does not arise.
